Can you advise my access rights as a
married (10 years) Father - of - one 11.5
yr-old boy if we have separated / both
moved out of the marital home but not yet reached court ? My ex says our sons welfare
is of the utmost importance but then prevented
all contact with me for six straight weeks. Surely Dads have SOME similar access rights without breaking down doors, but what are they?
She stole and sold my car illegally via a private trader and the police just call it a domestic!

Any pre-court orders tips welcome . Thx

Hi,

Contact is seen as the right of the child and not the right of the parent and the law does in majority of cases regard contact with both parents as in the Childs best interest unless there is serious child welfare concerns. The mother is supposed to be reasonable, so she's obviously trying to suggest that there's a welfare issue of some sort. Has she been specific?

I doubt mediation is an option at this stage, so I would look to make an application for a contact order.

Have you got a solicitor acting for you? If not I would contact the Coram Children's Legal Centre (www.childrenslegalcentre.com). They offer free legal advice to those without legal representation. You can speak to them via a free webchat facility or alternatively on their freephone advice line which is 0808 8020 008 and available Monday to Friday 8am-8pm.
