Hi
I have brought my daughter up since she was 1st born and she is now 3 .
My ex had custody for the first 3 months but because of her partying and drinking habits i won full custody with help from social services on my side.
My daughter is now 3 and lives in a stable home with myself my new partner and our latest addition.
In the court order made originally over 2 years ago my ex had our daughter overnight on a monday night only and i had her the rest of the time.
today in court she appealed for more time and asked for monday to friday , i now have a job and am no longer entitled to legal aid so had to represent myself , being honest i got ripped apart from her solicitor and froze when asked questions.
My ex has now got a court order for monday to friday starting next week ,
I cant see how the judge can overturn a order made originally and move my daughter from a stable home to my ex who lives with her mum and they will have to share a bedroom.
The judge did not want any of the past brought up and treated it as a fresh case even though i had all the paper work from the social services.
i am worried as this will be a massive change to my daughter and will affect her , i believe i only lost due to having no representation
Can someone please give me some advice ?

i would also like to add that when i got awarded the original residential order the judge said it was final , so how could she re-apply when there was no welfare issues with my family ?

I will ask the CCLC for advice, so keep checking back on here - one thing I do know is that the family courts always allow the option that either parent can go back to court at any time, and it seems as though you may have suffered as a result of this.

I could understand if they let her have a bit more time but to totally turn it around has devastated me my daughter is my world, i never dreamed this could happen as i mentioned i am the one who has brought her up , through nappys , teething and even getting her out of nappys to the potty , i have seen her grow up and she does not really know her mum.
I even let her have her extra on her birthday , mothers day ect , i have always been reasonable , the judges decision just does not make any sense. she was due to start nursery on Monday and i was looking forward to taking her but this is now all out of my hands !!!
I was hoping i could apply to the court before monday so i could appeal against this decision and get this latest residential order put on hold , so i could try to get some legal help , i really believe taking my daughter from a loving caring environment could destabilize her .

I've asked the CCLC to comment, but there is a link at the bottom of the website to their site - they have webchat and phone line help, so you might be better giving them a call first thing in the morning due to the short time available.
