[Solved] Appeal against legal aid

Hello,

Does anyone know if you can appeal against legal aid if rejected?

I've gone from living with parents to very shortly taking on my own place, yet my solicator isnt sure if l can appeal or change circurimates as l'm waiting to hear back from the legal commission.

Hi,
Prob is l'm just over the £733 so by being in my own place it brings the money down but also works better for staying over etc. Its a very thin line, but l think it might be worth the chance.

But surely l must be able to appeal against the system? Or its and unfair system, then again we're the dads!

Hi there

The trouble is that Legal Aid has been stopped as of 1st April. If you are allowed to make changes to the existing application because of the change in your circumstances then I would think your application could move forward. You wouldnt be able to re-apply because its no longer available.

Have you tried calling them and asking them to clarify your situation?

Keep trying forder. Unless you received a notice from the Legal Services Commission that they were closing your matter, you should be able to appeal as it's not a new application. 🙂

I'm not earning an amazing amount but it really all falls down to your outgoings, rent, csa, gas/electric etc. Have copied a bit here to help you out.

To be financially eligible you need to:

•Receive Income Support or
•Receive income-based Job Seekers Allowance or
•Receive guarantee state pension credit
Otherwise

i. The gross monthly income (from all sources) of you and your partner should not exceed £2,657.

ii. Assuming your combined gross income does not exceed £2,657 pcm the maths is:

•Your gross income pcm
•Your partner's gross income pcm
Less

•Income Tax pcm
•National Insurance pcm
•Allowance for partner £177.50
•Allowance for each dependent child £285.13
•Work related expenses for those receiving a wage or salary £45
•Maintenance that you pay pcm. This can include paying household bills or the mortgage
•Housing costs pcm (rent or mortgage): housing cap if you have no dependants £545
•Child minding costs pcm where your partner is not available to look after your child
If the resulting figure is £733 pcm or less you will be eligible in terms of your income.

iii. In addition your capital and that of your partner should not exceed £8,000.
