Hi this is my first time on dad info and i would be very appreciative for any help with my issue
My ex wife took my kids away from me to New zeland abt 15 years ago under my duress , I did not know were or when exactly my ex wife took them so i was informed by my solicitor at the time to stop paying my maintenance.
Quite a few years later i went to Australia to see my kids as they made contact with me. I was not aload to leave OZ until I agread to make payment of which I did, My kids are now 24 & 22 respectably . I no longer pay for my children due to their age but I still have arrears to pay, would you know if iam liable to pay these as they are over $20K dollars. Does the Australian CSA have duristriction to do this as I live in the UK,
Regards
Phil

Hi Phil and welcome 🙂

I think they do, I seem to remember reading on the Money Saving Expert Forum that the two countries have an agreement. Its certainly worth looking into further though, perhaps the Citizens Advice Bureau might be able to advise you.

In 2014 the CSA is to be scrapped and a new system put in its place. Theres a sticky with more information about this at the top of the Finance section. I think at that point arrears can be re negotiated with the parent thats owed the money without the intervention of an outside agency, so perhaps that might be an opportunity for you to get some closure on it. Have a read through it, it might help! 🙂

Hi , many thanks for your reply. I have just had a look at the finance page and the 2014 CSA announcement. My court order was made through the UK courts and not through the CSA.
It was in fact the Australian CSA that instigated that I pay my arrears when I was over in Australia to visit my kids after all those years of not nowing where they were.
So with the abolishment of the UK CSA, does that mean the Australian CSA still have derestriction to make me pay my arrears ?

I think this is one you'd need specialist advice on - I'm not sure how the CSA get involved here, but ultimately, you are still in breach of a court order, so it's possible that the CSA may be acting on behalf of the court.
