Hi I hope someone can offer some advise.

I was contacted today by the Aust CSA looking for payments and arreas of around $40k.

They have offered me some alternatives, firstly being that I come to a payment arrangement with them, but that would probably bankrupt me. They have also suggested that I have the case transferred to the UK and have the courts here decide how much the payments would be and also decide on how much of the areas I should pay, and they also said it may be possible to come to a single payment agreement that would end any future liability

I rang the CSA in the UK and they said that the case wont be transfered to the UK CSA but directly to the courts?

Can anyone offer advice or a course of action

Hi there 🙂

Was this the first correspondence you've received from the Australian CSA? Usually the CSA claim can only start from the point that the parent with care contacts them. For the amount of arrears to be so big the claim must have been opened a long time ago.

The CSA are not the easiest agency to deal with and if this has to be dealt with, its my opinion that it would be better to defend your position in court. If you have not had previous contact from the mother or the Australian CSA then you could argue that the amount being asked for is unfair as you hadn't been given the opportunity to address it when the claim was initiated...this is just my personal opinion though.
