[Solved] C100 query please

Hi, i have read the previous forum notes on C100 which are really helpful. A contact order is in place, but contact broke down a while back. Due in court for a clear cut c79 to be heard, but I have been advised to also apply for residency. Do you have any additional advice on s7 in this instance please? Many thanks

A court considering any question with regard to a child under the Children Act1989 may ask the local Authority to report to the court on such matters relating to the welfare of the child.

The purpose of the section 7report is to provide the court with information and advice as to what (if any) orders dhould be made to promote a childs welfare. This does not mean conducting a fulll assessment. It is not the Social workers role to resolve disputes when preparing a welfare report, although they may identify opportunities for helping the parties to reach agreement.

There is a strong presumption that the child will be seen when conducting an s7 enquiry, to give the child a chance to express wishes and feelings. They will usually visit both parents at home, and like to see the child interact with both parents within the home environment.

Hi,

Please accept my apologies for a misleading question. The case has been going on for several years through county court in search of proper contact with my 6 year old son. CAFCASS reports gave everything related to me a clean bill of health and there us now a court appointed legal guardian involved too. What i'd like to try and get some help on is the kind of things that i could put into q7 on the c100 for, to justify applying for residency (currently with Mother). As I say contact has broken down and i have been advised to apply for full residency rather than shared.

Hi Steve

Why have you been advised to apply for full residence and who advised it? Are there problems with mother, is she unfit, doesn't she care for child properly? etc

Why has the court appointed a Guardian - they don't do that lightly in children matters.

That is no problem for me and I will not hesitate in recommending further advice be taken on site, or I will ask it myself through PM with an expert boarder if I get into difficulty. I am not afraid to ask for help and obviously having worked for solicitors can be confidential ! LOL!I was going to say keep my mouth shut..but seriously, I can be and am confidential for obvious reasons.

My apologies for misinterpreting your question Steve...Just to mention if you take a look at the top of the Legal Eagle section there is a sticky called "Contact Order C100 Guide" This gives examples of how to fill in each section on the C100 form and might help too.

If there are safeguarding issues Steve you would need to complete a form C1a too. Q7 is more about what arrangements were in place, how they have broken down, the reasons for the application ie safeguarding issues, and what you want the court to do.
