[Solved] CAFCAS- Assessment & Sharing my Medical history

Hi there
this is summat important

the court has requested CAFCASS to undertake an assessment and prepare a report, which usually carry out by a Cafcass Family Court Advisor(FCA)

i got a letter saying that they are going to allocate a FCA to my case and he/she should be contacting to arrange a meeting soon. They will be attending my ex house as well.

Can someone please tel me what sort of thing they will be asking me?
will they talk to my current partner as well?

** One more thing! court has requested my GP to file a report(to knw if i have sucidal atempts or self harming case), my solicitor has sent that report to my ex's solicitor - is my ex also allowed to go through my medical report !? its quiet personal isnt it
im alright to share it to the court and solicitors but not to any individual esp my ex

The FCA will ask questions that are relevant to the information they have - I know that's vague, but each case is different, so it's not simply a set list of questions.

As you have a solicitor, we can't ask the CCLC for advice, so it's best to have a word with your solicitor on how much is shared with your ex - I would have thought that a letter from your doctor regarding the specific point would be all that is necessary for court, not ust general access to all of your medical records.

what is CCLC if i may ask

my ex asking for supervised contact saying that i have tried suicidal attempt or self-harming
at first, the court asked the report from my GP and i got a letter stating that im not under any mental health team
but my ex said my gp is trying to hide summat, well actuall he did
second time, court asked for the entire report and now the gp has copied the medical history including the consultations to sent it to my solicitor, and now my solicitor has sent it to my ex's solicitor. I knw there isn't much i can do at this stage but could argue with my solicitor as to why all the records are been sent to em

Do i need to be prepare for something before FCA comes?
i knw each case is different but are they going to come in a group or just the individual. do they talk to kids(6yrs old) in private?

What has the judge asked CAFCASS to look into, as that will give an indication on what they will be asking for you.

Generally they have a chat with you, ask about what you want for contact, ask about what you think the "barriers" to contact are. Does your current partner live with you? If she does they might want a brief chat, but generally speaking they only speak to the people in the court case, so yourself and your ex.

With regards to the children, the can either
a) interview them at their primary residence - they do tend to ask the parent to absent themsleves either by making a cuppa or something.
b) interview them at school.

What contact are you having at the moment?

In theory, your ex solicitor shouldnt share the whole medical report with the ex, but instead sum it up, so eg. he had x suicide attempts in whatever years. However your solicitor should have said on the covering letter not to disclose the report to your ex, but instead share with her a summary.

However I think you might have a problem given that you have lied about the suicide attempts, and its probably going to come back and bite you, I would expect CAFCASS to ask you about that.

I made a big blunder in my reply when I said we "can" ask the CCLC for advice, I actually meant "can't" - couldn't have got that more wrong, and now corrected. The CCLC is the Childrens Legal Centre, but they are unable to give advice when you have a solicitor acting for you.

Thanks Tony for your response

at the moment since court is unsure about my health condition, it is agreed that the contact will take place at my mums residence and it should be supervised by any family member. my mums lives next street and i visit her quiet often anyway

..can anyone tell what kind of consequences i may have to face lying about my suicidal attempts

The main consequence is that you may have lost the trust of the court, and you ex will be certain to bring this up whenever you make a claim she doesn't like, so it will probably lengthen the process of building up towards unsupervised contact - however, that's not certain, there are no hard and fast rules, so different courts can give different decisions. You are best coming clean at the earliest opportunity to the court rather than leaving it for them to find out.
