i recently found out my ex girlfriend who said she had an abortion 8 yrs ago has a daughter who looks identical to me when!!
i asked her and she said that the little girl could be mine so i offered to pay for a dna test she went along but when it came to it she didnt reply to my txt or messages and i dont know how else to get in touch or what i can do to see if the little girl is infact mine please can you advise me what to do next?

I'm sorry to hear about your situation. It must be quite confusing for you at the moment?

I'm no expert on paternity issues, but I suspect our friends over at the Corum Children's Legal Centre (CCLC) will be able to give some advice. If you scroll down you'll see that there's a link to their website at the foot of this page. They have a freephone number and a webchat facility.

I'd have a word with the CCLC, but I am pretty sure that you have absolutely no right to ask for a DNA test as you don't have PR, and you aren't being asked for maintenance.

I would have said that the best you can do is to try to keep in touch and to see if her daughter is interested in finding out when she is old enough.

no plan and simple i was told 8 yrs ago by the mother she aborted my child

now seeing a picture of said child has lead me too believe i could be the father

it killed me that she aborted my child or so i thought

i wont let the mother decide my rights i deserve the right to know if the little girl is my daughter or not

i just need advice on the right way to approach the situation best when a 7yr old is involved????

I've passed the question on to the CCLC directly, they will reply on this thread, it will be during working hours, hopefully tomorrow, but can be a bit longer depending on their workload.

thanks very much actd i just want to get a clear yes or no ive pleaded with the mum everyone that has seen the photos said that she loooks like me from 2yrs thru to 7yrs i dont want to leave it to long as ive missed out on 7yrs of her life if she turns out to be mine and thats enough in my opinion

If the CCLC don't respond by tomorrow, you can contact them directly on the freephone number provided on their website. They also have a free webchat facility. All you have to do is explain the situation and they'll tell you were you stand legally!

Dear Cantrill

In terms of obtaining a DNA test we would advise that you apply to the Court for a Declaration of Parentage. This can be applied for on a form called a C63. This form can be obtained from www.justice.gov.uk or from your local Family Proceedings Court. There is a fee for this application of roughly £200. Once you have completed the form you then need to hand it in to the Family Proceedings Court closest to where the child resides together with the fee. The Courts will then write to you with a hearing date.

We would advise mediation in the first instance to try and resolve Parental Responsibility and any Contact issues that there may be. However, if mediation is not deemed suitable you may want to consider applying to the Courts for Parental Responsibility and Contact.

Parental Responsibility is defined in s.3(1) Children Act 1989 as being: "all the rights, duties, powers, responsibilities and authority which by law a parent of a child has in relation to the child and his property".

Practically Parental Responsibility means that both parties should consult and consent on issues such as schooling, medical issues, change of name, removal from the jurisdiction and other major issues concerning the child.

You can obtain Parental Responsibility by:

• You can negotiate with the mother to obtain Parental Responsibility through an agreement. This form is entitled a PRA1. The form requires both parties consent
• You can re-register the birth certificate. This again would require mother’s consent.
• If mother does not consent you can apply for a Parental Responsibility Order. The form required is a C1.
• You can apply for a Residence Order and will gain Parental Responsibility this way.

You can apply for a contact order by completing a C100 form.

All the forms mentioned can be obtained from either www.justice.gov.uk or from your local Family Proceedings Court. The application forms do require a fee.
