[Solved] Changing baby's name

Hi all,

Can I just say thank you so far, as you guys on here have been so helpful!

I have a few questions about changing a baby's name. Yesterday my ex said she had now changed our son's name to her surname via deed poll. I have checked with deed poll and they say that she cannot do this without my consent too.

Q1: If she start's calling him a different name, is there anything I can do?

Q2: If it goes to court about changing his name because I object, which way do the judges usually rule, do they go in favour of the mother's name or the father's name (which is on the birth certificate)?

I'll ask the CCLC to pop on and give advice on how to get this corrected.

One question though, are you certain she has done this, or could she simply be lying about the fact?

She may be lying as I have seen no evidence but she seemed very certain that she had done it.

Update:

I got some advice from the UK deed poll who said that I should contact my child's surgery and ask what the child is still registered under but they refused to let me know. The surgery said they could not tell me because of some 'Caldicott law' (sp?). Even if i could prove i was the father they said they could not tell me which sounds bizarre.

I would guess it's doctor patient confidence, This seems mad as it's for a child but It still stands I suppose.

It also could be around data protection.

I know this doesn't help though.

How about going to your local registry office to obtain a duplicate birth certificate, they would have the name he is known by and how he is registered.

It does seem mad as the mother can know how the baby is registered but the father can't?!

I have already ordered a duplicate birth certificate (as i know she will not be willing to let me borrow it), they said it'd take up to 10 days to come through though. Hopefully if i go into the surgery proving my PR, they may be able to let me know the details.

Then I have the next step if i find out she has changed his name and what i can do about it because she has done this without my consent so I should be able to do something?
