[Solved] Child Maintenance Order in a European Country

I live in England and my ex partner and mother of our 3 children applied to the French courts for a maintenance order 4 years ago which was granted in the sum of 750 euros per month. Circumstances have changed - the currency exchange rate has changed dramatically and I am currently unemployed. This means there is a debt building up against me under this Order. My ex partner's circumstances have also changed in that she no longer has to pay any rent and is now working full time. I want to apply to have the Order varied but have no idea how to go about this. I do not speak any French and don't have any money to pay a solicitor. Any ideas?

Hi Fredrick,
Welcome and thank you for posting on Dad Talk.
I don't know whether it would have any bearing on your legal situation but I was wondering whether your ex and children were together in France.

I will ask our legal experts to look at your situation and give some advice. This usually takes a couple of days. They will post their reply on this thread.

Thanks. Yes I sold my house in UK and bought a property in France which is in both our names and where we lived together for about 3 years before parting.

Dear Fredrick 45

Unfortunately the Children’s Legal Centre can only advise on issues of English and Welsh law. Therefore we are unable to advise how to vary an order made in France. As the order was made in France the only way of discharging or varying it would be through the French courts. We would therefore suggest that you seek some preliminary advice from an English-speaking French solicitor. You may wish to contact the French embassy ( www.ambafrance-uk.org ) as they may be able to recommend French solicitors operating in the UK.

We hope this information has been of use to you. If you have any further queries in relation to an issue of English or Welsh law then please do not hesitate to contact the Child Law Advice Line on 08088 020 008.

Kind regards

Children’s Legal Centre
