Hi,

Firstly, I didn't have much luck with the search on this site, so my apologies if this has come up before.

After our break-up my ex-wife moved 50 miles away with my two sons. During term time (and work permitting) I visit them on Wednesday and they spend every other weekend with me. Over a two week cycle, this involves me driving 250 miles, and my ex-wife driving 80. Despite this disparity of time, money, wear and tear etc, my ex-wife will not accept a fairer distribution of the driving. Can the law help?

I have a family based arrangement with my wife which involves a payment based on the CSA calculation.

Hi There,

I don't think that a judge is able to order that she drives any further than she has agreed to, which seems as though you are getting the rough end of the stick.

I know that the csa will take into account travel expeses though if you spend over a certain amount to see your children, so it may be worth trying to re assess the arrangement you have over payment based on this, I believe it is if you are spending more than £15 per week, but I may be corrected on this.

I agree with Darren - the law is extremely unlikely to force your ex to drive any more, and if you went to court to try, it's even possible that your ex could come up with an argument as to why she should drive less.

Darren is quite correct in what he says about the CSA calculation - the CSA expect you to pay the first £15 per week of travel costs for contact, costs above that can then be deducted from your takehome pay when calculating the maintenance payments - unfortunately, in practice, this works out to be a very small reduction in maintenance payments. Once thing I'm not sure of is how they calculate car costs - it may be worth seeing if you can vase it on 45p per mile that the Inland Revenue allow for expenses.
