[Solved] contact order after residence order??

I split with my ex a few years ago & she got a residence order for our daughter. At the time no contact order was put in place. We subsequently got back together and then split up again last year. Since then things have been very strained between us and contact with my daughter has been erratic. The current situation is that my ex refuses to have any contact with me at all - she will not answer phone calls or text messages & has recently moved house & will not give me an address for where they live. Any contact with my daughter is arranged through my ex's mother and it seems to depend on what mood she is in on the day.
Can I apply for a contact order seeing as she has residence and is there any reason why this would not be granted? My ex is very vindictive & is of the mindset that if I'm not with her I don't have any right to be a dad (although she's more than happy to take the maintenance every week)

Hi seashore and welcome 🙂

The simple answer to your question is yes you can apply for a contact order. This is the C100 Contact Order. There is a sticky about this at the top of this section and also a Guide to representing yourself in Court, also as a sticky at the top of this section...lots of really useful info there.

You would first need to apply for a seek and find order, which is Form C4. This form asks for your details and your childs, with a recent photo if possible. You would submt this to the court with the fee which I think is £200.

Before this though you might like to consider Mediation. By the sound of it she would probably refuse, but if you make it clear to her that you are prepared to take it all the way to court if necassary, and it would be better to settle this between yourselves, she may then agree.

Here are a couple of links, the first is to the justice website, where you can get more information about the forms, fees and nearest courts to you. You can download the forms from this website. The second is a link to the mediation service.

Good luck with everything 🙂
