A quick question about costs. My Ex has employed a solicitor to gain a court order to vary the access arrangements. I agreed to the order in August after suggesting some changes and it's still dragging on.

Can her solicitor ask for me to pay her costs as in other legal cases? I haven't used a solicitor as I broadly agree with my Ex's request for changes even if I think they are unecessary, the main thing she wants is a residency order and as my daughter is 15 next birthday I don't see the point but I'm happy for her to have one.

The solicitor can ask for the costs but I doubt very much that they will be awarded, especially as you are compliant! Even in cases where one party has been unreasonable and obstructive costs haven't been awarded....judges just don't do it! I think it's because awarding costs could impact one the quality of life for any children involved.

I agree - costs are very rarely awarded in family cases, and certainly not in this sort of case.

Thanks both of you, very reassuring. I avoided using a solicitor as it cost me £6k last time and it would have been a cruel irony if I'd had to pay for hers!
