I have a court order to provide maintenance for my 2 children who are 17 & 13

Unfortunately in a house move I mislaid the order so I have 2 questions here please.

1. Can I apply for a copy of the court order from the magistrates that it was issued ?

2. My eldest is 17 and is in full time education at college, when he reaches 18 am I able to stop the maintenance I pay his mother ?

I have had numerous "discussions"............ok rants !, with my ex wife over this, she states that I am morally obliged to continue paying her the money when James hits 18 next July !!!!!!!!.

Advice is badly needed please

Yes, you should be able to get a copy of the court order without a problem - I would think you'll need a date and proof of who you are.

Your ex is saying you are morally obliged to continue to pay maintenance - that's different to legally obliged, so it depends on what the court order says, but I would expect that it would cease when he finishes college education - probably September next year.

Depending what your son intends to do after college - if he starts working and earning a living, then there would be no reason for you to pay maintenance for him. If he goes to university, then you could consider paying maintenance directly to him, and not to your ex.

I'd get a copy of the court order and then have a word with the Childrens Legal Centre.
