Can you please advise me on what constitutes an dependent child, I am currently living overseas and my youngest child (12 years old)wants to come and live with me. I pay a monthly maintenance fee towards his living costs. He has his mothers consent. Local work department have told me he is not classed as my dependent & will not fund travel or school expenses. Can you please advise. Regards. Steve

I would have thought that if you were wanting to claim anything - presumably from the government of the country in which you are resident - then the rules you need to clarify are those of that country. I would have thought though, that if you are the natural father, and you are on the birth certificate, that would go a long way towards qualifying.

Hi there 🙂

With very little information to go on its difficult to advise fully but in this country the parent that is in receipt of the child benefit is classed as the parent with care (PWC) and therefore the child that they received the benefit for would be classed as their dependent.

If the mother has given her consent for your son to live with you, it might help your situation if she were to sign over the child benefit to you...this should serve as proof of your sons status as your dependent. A letter from the mother stating that you are now his legal guardian and in receipt of UK government benefits for him might help too.
