My case is listed for 16th September 2013 i.e. this coming Monday!!

The notice from the JP's instructed that each party file 5 copies of a Position Statement, which I have done. I have just called the Court to confirm that my ex has filed hers, and she has not!!!

Should I give her notice that I now know that she has not filed? I don't want to give her any excuses to not show up at court.

What do you think?

If she has no intention of attending court, then giving her notice that she hasn't filed wont change that.

If she has a solicitor then you could contact them and ask for a copy of her statement, these guys often don't play by the rules and think nothing of keeping the statement close to their chests until the last minute! It wouldn't surprise me if they didn't file until the Friday before court!

Bri - it is often a tactic to file on the day at the morning of the hearing.

She may not turn up but then she will be doing herself no favours.

Agreed! There's supposed to be a code of conduct but some solicitors will push the boundaries when they can.
