hi there hope everyone had a good christmas and new year

if anyone has read my previous posts you can see what been happening with my daughter and her mum, but in short, i had to take my daughter from her mum with help from social services because she couldnt keep her safe from her borther. now my ex has applied to the court for a discharge of the residence order i have in place. i have a copy of her statement which is one lie after another and is just set out to make me look the worst person in the world. i can prove they are lies and i have evidence but what im worrying about is will i get enough time to address all the points to prove they are lies or will i have a short amount of time to try and cover as much as possible. also is it a good idea to send to the court a reply that covers all her points and if it is a good idea do i have to send my ex a copy?

I would think that you will be doing a statement to the court, and that you will have to provide your ex with a copy of your statement. You certainly do want to address all of her points in your statement, and do this in a calm and rational manner - the ideal situation for you is that the court see her as irrational and not acting in the best interests of your daughter, and you doing exactly the opposite. Have you also contacted childrens services to tell them what your ex is planning? It does seem that they are on your side, so having them back you in court will help you immensely.

Also, don't rush things through court - the more settled your daughter is with your, the less likely a court will return your daughter to your ex, and the longer the process takes, the longer your daughter will have been settled with you, especially of all of her emotional and welfare needs are being met.

lovely thank you for the advice, i have just spoken to the court and they have said that as we go back for a review on the 11 feb they will deal with all the issuses then, but i should bring my response down before then.
its all starting to feel a bit real now :unsure:
