After paying a direct agreed maintenance amount to my ex since 2007, she decided to go to the CSA in October to get a recalculation - fair enough. I have been in touch with the CSA to give them my income details for them to calculate the revised amount that I will be paying. All well and good so far.
I confirmed with the CSA on four separate occasions what the start date of the arrears that would be accrued (the payment would go up, but they couldn't tell me how much by so by the time the increased amount starts I will have some arrears) - I was told that this was from when the case was re-assessed which was the week of the 22/10/12. However, my ex has been under the impression that this is from the week of the 21/3/12.
She has received a letter from the CSA now confirming that the date that the arrears starts from is the 21/3/12 which was news to me. Apparently, she did contact them in March, but neither her nor the CSA decided to contact me about this. As such, I have only been contacted for a re-assessment (in fact, I contacted them to get the ball rolling) from the week of the 22/10/12 - all payments up to them are paid - and the information they have about my income relates to my October and November payslips.
I am of the opinion that the arrears therefore start from the week of the 22/10/12 - the CSA have told me that their files state I haven't been contacted about a re-assessment until October. If anyone has any advice as to when the arrears date should be it would be much appreciated - surely they can't say it is March when no one from the CSA has contacted me about this until October when my ex re-contacted them for a re-assessment?
