[Solved] do i write to court for report?HELP.

Hi,my solicitor has told me to write to the court for medical records about sons mother.only the judge at the first hearinfg said there was no need at this time.Only if the next hearing is to decide who son stays with till final hearing.Then why doesnt the judge want her mental health report?I cant understand.Trouble is dont know what to do.Should i request them anyway.As nanny jane said before it may not even be the same judge.Mother is saying she doesnt have therapy anymore,but this is only because she refused to go.Help..

Why cant the solicitor write to the court, hasn't your Legal aid come through yet? Have you had contact with CAFCASS?...You could talk to them about it. I seem to remember that the Social Services have been asked to write a report for the next hearing, it wouldn't hurt to give them a ring and ask them for advice too, share your concerns with them about the mental health issues and the lack of a report into this. If you dont get the reassurance you need then I guess theres no harm in writing to the court anyway, they will either ignore your request or go with it. Just make sure when the Social Services do their report that you tell them everything thats worrying you.

If the mother doesnt have therapy anymore why has she got a full time carer?

Have they had their contact at the contact centre yet and how is that going?

no legal aid yet!!! i have the name of her therapist so i will be ringing social services .they are trying to say she is well its ridiculous your advice is spot on and its great to have.There has been no contact arranged yet.I think i will ask social .services if i could go and see them? ,As i would like them to see the letter i have saying she is a danger to her self and others.What do you think NJ? My computer has been paying up, So only just got your message.

have just realized the lady who i thought was a judge at the first hearing wasnt,or am i confused?is it always a judge at first hearing?

Is the letter saying she is a danger current or was it from some time ago? If its from a while ago they might down play it. But yes you can show it to them. I think the fact that she has a full time carer puts her ability or lack of it into perspective, and you need to push forward with stuff like that.

Sometimes first hearings arn't presided over by a judge... I seem to remember ak57s son didnt have a judge the first time, but dont quote me! I'll try and find out.

As a report was ordered the Social Services should be making contact and will want to talk to you at some length. It wont do any harm to make contact with them though...just tell them that you were at court without representation and arn't too sure of the process going forward and whats expected of you. Ask about medical reports that havent been ordered, and the fact that her ongoing mental health problems are central to answering the question about her ability to care for your baby. You made a very good point when you said that if she needs someone to look after her, how on earth can she be expected to take on the responsibility for caring for a baby!

It was from a while ago,the disability living allowance letter that says she is a danger,but she recently filled out another claim (a few weeks before she left stating she was still very unwell mentally.)I think she must have been granted DLA,again as she has got a paid carer. I spoke to the CAFCASS,lady she said it wasnt even on there books yet ,I am not worried as the longer it goes on the better i feel.This must be why the mother hasnt had contact yet.Have the hair test soon but not bothered i have nothing to hide.The Cafcass lady said there will be a telephone interview before the next hearing with them so i will be able to tell them any worries i have,FEELING A LOT CALMER NOW. Just wish legal aid was through.Will ring them again today..
