[Solved] Emigration Plans and childs rights to choose

Hi there

I am planning on emigrating in a couple of years and I want to let my 11yo daughter to have the option to come with me if she chooses.

At what age are children allowed to have a say in this decision?

As I know that if it comes down to just me and her mother than it will not happen.

Hi

There is no definite age, it depends on how well the court thinks that she would understand the consequences of her choices - I would say that you would hav a better chance when shes around 13. However, it's not simply a matter of giving her the choice and she can come with you if she chooses, you are going to have to go for a residence order, and as your ex is (I assume) currently the resident parent, I think your chances of success are pretty remote as it will be removing her from a stable environment of home, school, friends etc which courts are usually loathe to do.
