[Solved] Ex Refused Legal Aid Despite Aleging DV

Hi,

My ex has been making much of DV alegations the whole way through proceedings but Ive just found out that she has been refused legal aid and that she wishes to submit her alegations late having missed the court deadline by 4 weeks.

My solicitor has informed her solicitor that we will oppose the late submision vigorously.

I wonder what will the fact that she has been refused legal aid mean to the judge as it seems to back my response that the allegations are false.

Also given the very late submission of her further alegations and refusal of legal aid do you think that he will allow her to submit them?

He was really annoyed with her and her solicitor last time for pushing the DV alegations.

...she's not doing herself any favours is she Dave!

If she has a solicitor how come they didn't get the submissions in on time...that's what you pay them for. The judge might haul them over the coals but the family court is notoriously lax at sticking to court procedure, or at enforcing them.

So I'd hate to say either way on this one., but fingers crossed eh!

Yes I dont know if it was money or the fact she is mad as a box of frogs or that her solicitor is a punk who is younger than some of my underpants.

I hope the judge gives them "another" dressing down and doesnt let them submit it but stranger things have happened.

Hello Dave matey,

we were thinking this werent we - great news. She is getting into more Debt and I suspect she wont be able to afford the punk for the final hearing.

It is building you a case and its has good into warp speed now. What your solicitor should do is send some correspondence highlighting this and emphasising the false allegations and would it be worth writing to the judge to infering her deliberate attempt not to submit this and infer this adversely.

...yes keep the pressure on, but be careful not to come across as vengeful, it's a fine line and you certainly don't want her to get a sympathy vote because her snotty nosed solicitor is incompetent. I feel had you been a LIP and were opposing her late submission it would be frowned upon but as you've got a solicitor doing it the same inference won't be made!

If the family courts acted to the letter and followed the proper procedures then she wouldn't be allowed to get away with any of the stunts she's pulled! But we all know how [censored] unfair the secret family courts can be..... Grrrrrrr
