Could someone please answer the question whether If I work for a French company with a Swiss payroll do I still have to pay maintenance for my son?

The reason being at the moment I pay my ex to her account by personal arrangement more than 15% of my annual income along with additional money to a seperate account for my son for when he is older. My ex believes that she will get more if she goes through the CSA and I have heard that I am exempt because I don't pay UK taxes and that my payroll is Swiss. I just want to prove to her in writing that if she doesn't stop being greedy she might end up with less or (If I was a bad person) I could refuse to pay at all.

I know I could call the CSA but where I am in the world at the moment communications are limited and would like an outside point of view.

It's not about the money from my point of view it's about greed and knowing the facts before she wastes her time and is disappointed.

Hi there

I dont believe where you pay tax, and being on a foreign payroll has a bearing on maintenance. If this government has an understandiong with the Swiss then they can have duristriction. If Switzerland is part of the EU then I would imagine there will be such an understanding. The CSA would probably obtaibn a court order....it would be advisable to look into this further but this is my thinking on it.

You can google CSA calculator and after filling in the questionaire it will give you an amount which you can compare wth the amount you are currently paying.

...me again! I've looked into this a little further and found this blog entry by a well respected family lawyer. Have a read and see what you think. It appears that you are not liable if you dont reside here or work for a UK based company. However if you read the comments at the end of the blog there is mention of the EU directive concerning child support, and if there is court ordered child support then enforcement can be applied from whatever EU country the non resident parent resides in.
