To elaborate on BRD's post - it is possible to get custody (residence order) - I have done it and there are other dads on here who have done the same. It's still unusual (at the time - 7 years ago, my barrister said that legally speaking, I was something of a freak 😀 ) but if the circumstances are right, then it may happen. Your solicitor presumably thinks that the circumstances warrant this, but without further knowledge of your circumstances, it's difficult for us to give an opinion on here.
