[Solved] Heading for divorce "negotiations"

Hi all, looking for some advice please.
Heading for divorce negotiations on Thursday with ex.

She's in "family" home with kids.

My solicitor says if I can get her to agree to paying half the mortgage, this will almost equate to CSA calculated figure for my earnings.
The Key question is.... (apologies for being a bit dim here)... do I have to pay the CSA figure on top of half the mortgage... in effect paying twice?

I am not a callous man, I will pay what is right and fair, to keep the roof over my childrens heads, I believe I may have to pay some "spousal element" in addition, due to low earnings. I have offered also to contribute to "school Trips".

The Solicitor also advised me that if the payment of the mortgage were to come entirely from her account then this would have the likely outcome of increasing her benefits as she would have additional housing costs.

I have been fleeced for the past 2 years of Separation... but vcannot afford to do it any more.
All help gratefully recieved.

Hi Aid,

If you pay half the mortgage then you will still be liable to pay CSA as well the CSA will be calculated from your wage, the mortgage will be additional.

I don't know about housing benifits if she does cover the whole amount but would suggest your solicitor would probably be right, be careful though if you do stop paying your half of the mortgage in exchange of a CSA or spousal paymengt as she may later on use this to push for a higher % of the equity in the house should you ever look for her to buy you out or sell up.

Echo that.......CSA is always taken.

Mortgage is different and if you cannot both sustain housing needs you may have to suggest making ti more affordable so both of you can provide for the children.

CSA do have a complex variation officer who would take this into account but by the time they start deducting from your salary I suspect the CSA would take about the duration of the mortgage to work out that you still probably still need to pay the same amount.

Your offer sounds rather generous.

You may not need to pay spousal element depending on your circumstances.

I presume you are basing this on a 30 year mortgage, rather than a 25 year mortgage :whistle:
