hi all split with my partner a month ago at first things were not to bad but now she as got a soliciter and im getting the lot she saying i domestic abused her of which is not true will this go agaist me in court cause that the way it going has have not seen my 2 boys for 3 weeks now and she had a police escort round to coll some of her stuff when she has been round twice on her own to coll items any 1 else been though this if so some advise would be nice cheers

Hi there and welcome 🙂

You must tread very carefully now that there has been accusations of domestic abuse made against you. Dont try and make direct contact as she can claim harrassment.

She will most likely try and use this against you in any future court case, so with this in mind keep your dealings with her strictly through a third party.

If you are unemployed or on a low income you may be entitled to Legal Aid, however there are new rules governing this that will come into effect in April, so if you are eligible I would get yourself a solicitor fast! If you are not entitled to help with solicitors costs then you might want to consider representing yourself in court, there are lots of Dads that have taken this course of action and you will find lots of helpful information about this at the top of the Legal Eagle section. There are two stickys, one is called Contact Order C100 Guide which is all about the form you would need to fill in and submit to court for access to your children, there is a charge of £200 to apply. The other is called A Guide to Representing Yourself in Court.

hi thank you for reply she was trying it with harassment but have stopped any contact now am unemployed at the mo got a soliciter that i am going to see tomz will keep u updated just getting me down every day something new i got loads of stuff on my phone that will go in my favour to show she did not look like the person that had gone though dom abuse will that stand up in court and friends of both of us that have laughed at these domestic abuse allegations more advise would be nice thanks all

...Thats good! If you could it would be a good idea to get the txts photocopied from your phone, send them as an email and then they can be printed off. Its a good idea to start a diary and record everything that happens, it will be helpful if you go to court.

agree, keep copies and print outs of anything that you can use against her.
Never speak to her alone or see her alone, save more accusations and start legal proceedings against he for contact with your children asap
