4 years ago i had a DNA test and my daughter was shown to be mine since then i have been chasing my tail over Farther's right.....what i want to know is do i have Farther's right because the DNA test proved i am her Farther

Are you named on the birth certificate?

If not then as it stands you dont have any rights, but you can apply for Parental Responsibility which would give you some fathers rights. You can do this with the mother or without her. With the mothers consent all you would need to do is go together to court and sign a parental responsibility agreement and have it witnessed. Without the mothers consent you would need to apply for a court order, it costs £200 and you would need to fill in a form C1 and submit it to the court.

Do you get any contact with your daughter? Is this the reason you are trying to establish if you have rights?

If you are able to answer this question then I can get the Coram Children's Legal Centre to pop by and offer you some sage legal advice regarding your rights. Their advice will differ depending on if you are named or not.

no im not on the BC and and my contact is as and when i or my daughter can afford to see each other i now know that i can have my name added to the BC and that it will cost me 200 or there abouts. the reason i wanted to about my right and or how long it can take to add my name to the BC is because i want to take my daughter abroad on holiday and her mother is refusing to let me to quote "i hold her passport and will never let you have it " i think this is unfair on my daughter as she is missing out on family holidays with her little brother. Also if the law dose not allow the same rights for fathers is this not a clear cut case for sexual discrimination???? and even more so for fathers like me that have that have had a DNA test and been proven to be the farther??

Hi

Can you be a bit more specific about how often contact takes place and how long it lasts each time?

As for your point about discrimination, it's not sexual discrimination, but more a bias to the parent with care - there are fathers on here (including me) who have custody and the mothers are often in the same position you are in.
