hi guys,
first of all thanks for all continued support and suggestions.

my concern is about child maintenance-
my ex has applied for child maintenance before(when she was working) so csa confirmed back to her that i dont need to pay anything as a child maintenance.
but now she is totally on benefits and looking forward to apply for child maintenance. Can someone please explain the below queries to me:
1. is Child maintenance is paid my non-resident parent, whos having contact nearly more than 200hours per year?
2. if non-resident parent is on benefits, do he still needs to pay for child maintenance? if yes, how much it should be? can i claim extra benefit for that
3. can CSA force me to pay the maintenance?
4. what are the scenarios she can claim child maintenance? or is a way she can ask money from me

can someone please shed some light on this

I pay my ex what ever we agree, CSA not involved. If you could come to this arrangment your ex might be better off, because most of what she gets from you will be knocked off her benefits. Doing it off the books might be an option.

Hi,

Can't remember the full details, but generally if you (the non-resident parent) are on benefits or earn less than £100 per week, then you pay a flat rate of £5 per week maintenance. It's worth having a word with the CSA directly, or going onto their website which will explain more fully.

Maintenance is a totally separate issue from contact, so the amount of contact you have is irrelevant.

its nothing clearly mentioned on csa website.

i dont understand, why did csa denied my ex stating i dont need to pay her for maintenance(when she applied whilst working). if csa can denies at one instant, can approve/agree on later

Hi there Info,

This does sound strange indeed. The CSA never normally deny any case that is entered. As if a claim for Child Maintenance is applied, then applied it must be.

Under the CSA guidelines (and law) the following applies:

NRP (you) with an income of:
______________1child______2children______3+children
£201+ per week = 15%________20%__________25% payment of net income (called the basic rate)
£101-£200 per week = reduced rate (as it can affect protected income usually ~15%)
£5-£100 per week/JSA = Flat rate of £5 per week
£0~£5 per week (nil income i.e. Student) = £0

I would suggest you contact the CSA 08457 133 133 (Advice Line) and find out exactly what they are doing. Contact us back and then we may be able to help some more 😀

spoke to CSA, they confirmed i dont need to pay anything for child maintenance. but i been looking and asking people around and they confirmed that even if im on benefit i have to pay £5 a week towards to child maintenance.
im sincerely looking for legal statement where it says that.

If anyone are paying £5 even being on benefits can tell me where it says to do tht

just really repeating as what has been said but maintance and access are seperate matters and my mate is on benefits and only pays £5 off his giro.also i find it sad that csa dont take the hours into consideration you get with your kid they only take overnights into consideration allowing for maintance to be reduced if you where working.also if you was working the benefits ppl now dont count cash you pay towards kid as income or whatever they call it so she would get any maintance and it would not affect her benefits.
