Hoping someone can give me some advice on this...my son was born in September 2003. At this time I wasn't involved (my own choice) and I wasn't registered on the birth certificate. In July 2004 his birth was re-registered with my name.

My question is around the change of law that took place on 1st December 2003 does this mean that even though my name is on the birth certificate as he was born pre-1st December I do not automatically get PR?? Or is it a case of PR being based on the date of the re-registration rather than his birth??

Hi Taz and welcome 🙂

Thats a good question but I would assume that as the birth was re-registered after 1st December 2003, you would have PR. However I dont know for definate....I'll see what I can find out for you. I'm sure the others here with their wealth of experience might be able to give you a more definitive answer.

Hi again....I've had a google about this!

For children born before 1st December 2003, to obtain PR the birth must be re-registered... it appears that the re-registration must be done jointly with the mother as an authorized agreement, or it can be done by the father alone if the mother signs a statutory declaration that you are the father. Or if you applied for a court order giving you PR.

I think I can safely say that you do have PR. Congratulations! :cheer:
