If your order is for indirect contact, then there can be no arguments that she is moving purely to prevent access, so as long as she sin't moving out of the country (Scotland is classed as another country, incidentally) and she is moving for a genuine reason, a court would not prevent her from moving

Hi Jasey78 🙂

Unfortunately as actd says theres not a lot you can do about it. This often seems to be a tactic that some mothers use to make it harder for Dads to see their children... but one the courts are quite indifferent to in my opinion.

A tad misunderstanding! She is not aware that a know she is preparing for moving, And I would say her sole motive for moving is to avoid the indirect contact and also avoid the fresh application she knows I will be serving in jan of 2014.

I don't think moving would stop the indirect contact - does she have family/friends/job where she's moving to?

the moving will affect the indirct contact simply because i will have no address to send it to. i havent got much info about it i just know she will be moving in the same area.

If she's staying in the same area, then there's nothing to be done at the moment as far as I know - it will be a matter of going to the court for enforcement if she moves and prevents indirect contact, you don't have anything you can present to the court before then for them to enforce.

I think the best thing to do would be to write to her and discuss her plans for moving and remind her that if she does she needs to keep you informed and give you her new address so that contact can continue as the court ordered. Remind her that if she moves without giving you the forwarding address that she would be in breach of the order and you would then go back to court for enforcement.
