Is there a limit to how much savings you can have to qualify for this?

Its not quite what you think, My ex has gone and got legal aid for our divorce, now knowing that she has over £6,000 in an isa (& readly available), she only works part time but managed to save this money whilist we were together & I was struggling to meet everything (there has been an unfair ratio of household contributions).

ironicly she tells me that I am being divorced for "unreasonal Behavoiur" when i asked what sort she says the debts you incurred!

Foolish? yes I have been!

Hi mytwodarlings
We are not able to advise you regarding Legal Aid, and the limit on savings.
You could contact ‘Community Legal Advice’ which gives free legal advice and also has information on Legal Aid.
I have attached a link for you:
http://www.communitylegaladvice.org.uk/

You could also contact CLC as suggested above.

If you are struggling with debts and would like some advice on your options, you can go to our online Debt Remedy facility.
Debt Remedy would assist you in completing a financial statement and you would be provided with tailored advice on the best way to deal with your situation. This link will take you directly to Debt Remedy www.cccs.co.uk/ref/drcu
Alternatively, you can call free on 0800 138 1111 to speak to one of our debt counsellors.

Dear mytwodarlings,

Thank you for contacting The Children’s Legal Centre.

When it comes to being eligible for legal aid, both income and disposable capital are taken into account. The disposable capital/savings threshold, above which a person would not be eligible for legal aid, is £8, 000. Disposable capital can include money in the bank, valuable items and the value of your home (if you own it).

Before legal aid being granted the capital and income of your ex partner will have been considered. In this case it appears that your ex partner’s savings are below the threshold and therefore would not prevent her from being eligible for legal aid.

For further information on legal aid and the eligibility criteria you may want to look at the Community Legal Advice website which can be found at www.clsdirect.org.uk .

We hope this information has been of use to you.

Should you have further questions please feel free to contact our Child Law Advice Line on 0808 0208 008.

Kind Regards

The Children’s Legal Centre
