[Solved] legal aid stops in april

Hi all,
When legal stops in April 2013 for family matters, will it just stop in April or continue if you have an on going case?

I have to pay for my legal advice where as my ex is on legal aid and keeps going back on mediation agreements, we have to goto court.... would it be in my interest to put it off till April?

Hello,

I too could really do with an answer on this one.

Have a hearing 1st week in April 2013 to review how my contact is going at a Contact Centre, 90 mins per fortnight. The contact has not yet started but I am hope for some time in January.

My ex has legal aid.

I think, but am not 100% sure, that if you already have been awarded legal aid it will continue past April.

There you go basically the solicitor can choose to continue the work past April 13 under their current certificate. If they refuse, the odds are the client will not be able to get another legal aid certificate as it will be classed as a new case.

However, you will not be able to move up the layers of legal aid help. So for example if your certificate doesnt already allow for heo at court, you wont be able to apply for it past april.

So in your exs case, the best thing for her to do would be to go to court now before the cut off, as that way she will continue to get it :whistle:

In your case assuming she doesnt already have a certificate allowing for help at court, then it might be better to wait until after the changes.

Bri - I assume in your case your ex already has a certifcate for helo & representation at court, in which case unless her solicitor stops doing legal aid she will continue to get help.

I'm going at it alone, sick of solicitors now who dont do anything apart from charge!!
mediation was a waste of time for us...

on a plus side ive had my son NYE and new year day 😉

Im quite happy for this change. Firstly for someone like me who earns too much to get a solictior but equally cant afford one it is great. The ex claims legal aid and utilises her solictors for everything right down to communication of the welfare of our son (via email). Too long has this system been abused and it does not encorage parents to act like adults to talk and discuss matters. i for one am happy this is being brought in as it will level the playing field a bit.

The con's are i can see a number of women (and men) falsely alledging DV. I'm 100% certain solicitors will 'coach' people into this. Im sure these solicitors will loose a large revenue stream because of it.
