Hi all, Well good news, i won temporary custody of my son and i go to court on 28th august, supprise supprise she has got very evil, she is claiming that she was a battered wife and lived in fear of me, she is worried about my son being in her care due to my regular alchohol and drug use. i have said i am happy to do whatever tests they require me to do and welcomed cafcas reports. he is back in school and so very happy to be with he's daddy. she is trying to get him back on tuesday in court and file for this non - molestation charge, she has not got any witness's and is lying throughout the whole thing. any advice. can the court rule i give him back even though i have already got a order. many thanks

That is good news glad your boy is with you.

As far as I know the court could change the order that is in place, I would say that it isn't likely though as from what you've said they have made the order in your favour for a reason, unless they had grounds to change it I wouldn't think they would. The courts are used to mud slinging to try and get what's wanted and tend to dismiss it unless there is some good proof.

Hopefully all will be ok, keep us up-dated though.

Darren
