Hi guys,

I've been real busy the past few months with work / my daughter, the usual so not had a chance to post this for a while. My daughter is currently located 200 miles away from me and is starting school in sept. This, initially was supposed to take place back home as they were set to move or were at least "trying to".

This has fell through numerous times and the court at the last hearing were made aware that they had intention of moving which, i'm told is still going ahead if the job that they have been waiting to hear back from for near 2 months is obtained.

I think i'm being strung along for a ride here, I really do.

Is there anything I can do, the court can do to insist that my daughter is closer to me she misses me like crazy and only gets to see me once a month and half of holidays due to cost / time and holiday from work (I take 2 days a month off to pick up / drop off for last weekend of the month, it's £80 in trains most months and I only get 24 days paid. I have to work my [censored] off to get days in leiu for Holidays).

She has expressed that she wants to be closer too. She's here now and just tells me that she misses me / wants to stay etc.

I don't know what I can do to bring my daughter closer so she can see me more often.

If anything, that is.

Hi Rik,

First off well done for keeping up the effort to maintain contact with your daughter.

I would actually say several things relating to your post:
- About the move back, be cautious on this issue. This can be very often used as a ploy or delaying tactic by custodian parents...

- Relating to travel, can you not speak to your ex about perhaps looking to meet half way. Do you pay maintenance? If this is through the CSA you can look at getting a reduction on the grounds of travel... there are catches but i'll say those only if you reply that you do go through CSA...

- If you are saying that your daughter is moving back to the vicinity of you, you could apply to the courts for a Shared Parenting arrangement 3nights one week and 4 the next. This is becoming much more commonplace i am pleased to say...

She's started school today (which I MISSED) and I didn't even agree to the school. Is that even legal?

I can't get an adjustment on that, it's not worth the fight.

Since I dropped Mollie off last week she's ignored my calls and texts. I'm supposed to talk to my daughter saturdays (4pm usually) and Sundays too as a general bonus on top of seeing her as often as possible but she's obstructed this (which is an INTERIM COURT ORDER).

Today was my daughter's first day of school and I didn't even get a picture. She's ignored calls to see how Mol got on at school (after she'd finished) and had a missed call from her yesterday which I couldn't return because she kept hanging up.

Can I take this straight back to court?!?

She did mention that she was ill but why should that affect her ability to send a message or return a phone call??

It's clear that she's just going back to the same old routine.

Hi rik,

Technically there is nothing illegal about it but generally parents should talk and discuss these issues. Its what part of PR is about.

If she has obstructed this, make sure you make a note for the next hearing. If this is consistently being ignored then the Legal Adviser and eventually Magistrates will have very stern questions as to why these directions were not being followed.

You can't take this straight back to court but could request a review of the interim order (4-6wks) to say that she is not following the order. In fairness a child is genuinely ill then maybe so however like you i would question as to how ill she actually was to not be able to take/make a phone call!

Yes it sounds that way to me.

In my court case i remember waiting for my order to be produced and remember saying to my Dad that i would be back here within the next 12months. Generally there's women who care, and then there's women who don't. I think we both know what ones we were with, and oddly you learn more about them from separating than you ever have/had done living with them.

And of course for your daughters sake, keep working your [censored] off to see her, it seems quite clear you are important in her life.

It's not my daughter that's Ill though. Apparently it's my Ex.

i'm just worried because this time last year (there are posts knocking around somewhere) was when she ignored me / didn't let me see My daughter for 3 months until I had to go to court. she used being ill as an excuse while i KNOW for a fact she was working and local to me too because We know the same people.

Whatever it is, it's not fair on my daughter. I wish things were different and there was more support for small children to live with their fathers full time. I know for a fact My daughter would prefer that and I know i'd never obstruct my ex seeing her.

Women, eh?

Can't live with 'em, Can't drive 'em off a cliff. 😉 )

Hi rik,

Sorry my misunderstanding.

Even if your ex was ill she should have made an effort to return calls. And we of course both know the likelihood is that she wasn't ill. It is a stalling tactic to claim illness in many instances. Likewise courts cannot go against Medical advice in this country they always have to err on the side of caution.

Make sure you keep pressing on the courts too 🙂

Indeed. It's a bit stupid how this comes out of the blue with no warning. If there's anything wrong surely I should know about itm right?!
Fact that i tried to return a missed call 4 times and got rejected says it all. I'll try again tomorrow as usual.

I'm giving her one more week, after that I'm going to insist the next hearing be moved forward to review interim arrangements. There's no way i'm going more than a couple of weeks without seeing my daughter. She messed me about last year and i'm NOT standing for it again.

(btw - she said that i was selfish for going to the courts because SHE wasn't well and SHE had some personal stuff going on, Not once did she ever tell me / make me aware OR attempt to make contact regarding my daughter despite my efforts and when she did it was just to abuse me via text).
