In a nutshell for 10 years since splitting been giving my ex partner cash for our 2 Children (I have them every other weekend, and my daughter stays every Wednesday as well). her marriage has broken down (she re-married) and she wants to up the support I give her to the level in line with the CSA calculator (Note we have never gone through CSA but was a private agreement) and also weekly, What I would like to know if anyone can assist me, I have agreed to the higher level and to pay weekly but I no longer want to give her cash what rights do I have to insist it is paid to her bank as she does not want it this way?

If anyone can help it would be greatly appreciated

Tread with great caution I got landed with ten years of CSA arrears and was unable to prove the 12k i had already paid I am now down £500 a month with arrears at 14k. If you have paid her cash for the last ten years there is no way you can prove this in the eyes of the law. Don't know if this relates to you but i had a mate in the same situation. His ex didn't want anything through the bank or anything to be recorded because see thought it would affect her benefits. he also ended up with 40% of his wage down. no matter what you do i would make sure that all future payments are recorded and clearly read as maintenance on your bank statements. My reply may seem extreme but i am deep in the S@!t from a very similar situation. I don't want it to happen to ANYONE else.

You need to get your ex to sign to say she has received maintenance from you in the past without delay.......

then you need to get the new maintenanc recorded....best way...BANK!!!!

CSA will believe her over you if you cannot prove it!!! FACT!!!

Best way is the bank, as above, and make sure you quote "child maintenance" on the reference otherwise the CSA won't necessarily believe that it wasn't for something else.

If you do pay cash, get a receipt signed by your ex every time you hand over the cash and keep them all safe. But I'd go for the bank payments if at all possible.

Can't stress enough mate i paid through the bank but because the back statments don't specify maintenence the CSA won't take it into consideration I have been well and truely stung so please protect yourself
