[Solved] mediation

it seems my ex is delaying mediation. she cant make the appointment until at lease mid march!
saying she needs to arrange child care.

my question is can I start proccedings for a contact order now?

Hi yes you can, it takes about 6 weeks to get a first direction hearing and at this hearing they will just state what cafcass recommend which is usually mediation but they will give a date to say when mediation should be completed and another date for court to reveiw whats happened in mediation

Hi,

It does seem that she is stalling mid March is a long time away and can't see that a judge would accept this as a reason.

I would contact your ex and inform her that you need to attend before that date as things need to get moving, advise her you are sending the court papers off witha view to moving things along as soon as possible and that you are still hopeful to reach an agreement through mediation but that you are wanting that agreement to be written into a court order.

You are then covering your bases, if your ex is truling having child care issues then you have been up-front about the court papers being sent off, and if she doesn't you are letting her know that you want to move things forward and won't be left hanging.
