We have our first mediation appointment that begins tomorrow with an initial 45 minute meeting and if the mediator thinks we can make progress, then another 2 hour session next week.

We are at complete log a heads and can’t see how we can come to an arrangements, but going to give it a shot.

Anyone got any advice on this? If the mediation breaks down, does the judge get a report of what was said?

The mediator is trained so take his lead, listen to your ex's point of view and try to remain objective....the best agreements are those where you are both willing to make compromises....it's got to be a two way street.

If mediation breaks down then whoever first approached the mediation service will be issued with a form FM1 which you would then submit to court when you make an application.

Wish you the very best dadtalk, my ex would not agree to even give mediation a go and refused numerous requests for mediation, demandig to go thro courts.

I am hopeful she will turn up to court tomorrow as this will be the third court date we have requested for her to attend.

Sorry DT...you're already going through the court process! Doh! ....another senior moment I'm afraid.

The FM1 would need to be filed with the court and both sides and CAFCASS should also have a copy.

Thanks guys..

We did book mediation a few months ago but the ex then decided to cancel it. Just got some information from the firm doing the mediation and it doesn't seem to scary. Just going to be open and honest and hopefully something will come from it.
