Hello all, i am new to this forum and need a little help. i have a mediation agreement from april 2010 and now my ex says it is going to change becuase she wants it to. i have told here i am happy to change it but not to what she has said she wants as it give me less time with my son than i currently have. Firstly is a mediation agreement a legal document, is she allowed to do this and what is the best route to go to stop it. thanks for any help.

Hi Mate

Unfortunately as i understand it a mediation doc is not a legally binding agreement. It more like a hand shake agreement but if this child's routine is being changed and you don't think its in the best interests of the child. I say the child cause that's all the courts and legal system consider your and mum feelings are not important to them. Then its best to see a solicitor and seek legal advice.

as said mediation isn't legally binding unless written into an order once agreed upon.

As the agreement has been in place for a good few years and has clearly worked well, any judge would look favourably in my opinion.

Why is she asking for the change?

She is saying that as he starts school in sept she wants a more steady week for him. at the moment i have him tue 3pm - thurs and take him to pre school, then i have him sat 5pm till sun 5pm. she wants to change it to her mon - fri and me fri 5pm-sun5pm. it means i loose one night with him and also give me huge problem as i work at 6.30 am sat mornings till midday. She says she doesnt want me to have contact with him in the week to give him a settled school week, but feel he needs me in the week as well. we have a great relationship and i have never been late picking him up or taking back and her money is always been paid on time. i have agreed to change the times i have but not to what she wants but she is refusing to even meet me to talk.

Starting school can often be a time when changes need to happen, are you able to see him one evening a week as a swap for the saturday morning.

As you had managed in the past to gain a working agreement I would say you probably could again as long as you both have an open mind.

I have agreed that it needs to change just not to what she wants. i am avalible most evenings during the week but she is saying seeing me will disrupt his week and i dont agree. we have had problems today as i went to pick him up and they were not there when i phoned she told me i was not having him as her new rota was starting. after much discussion and many accussations she finally turned up with him. all i am wanting is it to be fair to all of us.
