I have an appointment very soon to see a mediator. This is the process I am having to take since my ex decided to cut my access. I understand that attempting mediation is a must before going to court but no matter what is decided in mediation I still want to go to court as a verbal agreement is just not worth anything to me as I know my ex will still use my daughter as a weapon and mess me around.
Can I send off the c100 form now as it takes 6 weeks to be processed and still attend mediation. My thinking is that if we cannot agree on access then I have a good head start and if we do agree I can get it stamped in court for my peace of mind.
Any advice would be much appreciated.

Hi There,

It's a slight misconseption that Mediation is a must before court, Some judges will insist on it and some won't it is recongnised though that if you can agree in mediation it is better all round than a judge making a ruling.

You can send in the forms and make it known at this point that you are trying mediation and wish the court to make any agreement made into a formal order, but in back up in case you are un able to reach an agreement you may want the judge to help in that respect.

I to went to mediation.... she went back on the agreement within a week, i was told 'its not worth the paper its written on' it cant even be brought up in court unless you both agree!!
