hi I am kinda new to all this not just the separation but the whole intrenet thing my question is that my ex partner who is Australian by birth wants to take my kids back to Australia {they were born in the uk and are 5 and 3}just had the first letter from her lawyer stating her plan and have just got myself a lawyer what are her chances of pulling this off? I know it will end up going thro the courts who usually wins these things?

Hi

It's difficult to predict the outcome unfortunately - your solicitor is probably best placed to answer this as he will have all of the facts, but unfortunately, it is a possibility since your ex is from Aus, and is presumably wanting to go back to be near her family. Having said that, it's also possible that you may be able to prevent it, either with a prohibited steps order, or by applying for residence yourself.
