[Solved] Payne v Payne. Relocation Overseas.

Hi. I have just recently been hit with an Application for Permanent Removal from my ex to take my daughter (4) overseas.
Anyone out there who have been through this and come out the other side ?
Any advice would be greatly appreciated.....

Hi

I would get legal advice on this - what basszebra says is true, BUT a court can give permission for such, and I assume that this is what the application is for. If you don't have a solicitor acting for you at the moment, then I'd give the CCLC a call (link to their website is at the bottom of this site) - would appreciate if you could post back on here what they say as it could be useful.

Hi, It will all boil down to Payne v Payne. And although I have PR, Cafcass are now doing there 4th report in 4 years, the last report was completed in August 12 and my extended time was granted in Family Court on September 14th 12. 2 weeks later she files for permanent removal.
Nightmare.

In which case, I would come up with an alternative plan in case the court allow the move, ie looking at how you can maintain contact and whether the court will order that you ex pays at least some of the costs of doing so
