anyone know please what time duration do you have for complaints to cafcass? thank you.

Dear Jasey78,

Thank you for your enquiry. If you are unhappy with CAFCASS or the report conducted by the Children and Family Reporter it is important that you let the court know about your concerns.

You can also complain directly to CAFCASS. Below we have added information from their complaint’s information.

“The responsible manager will contact you after you tell us you are unhappy. This is to make sure they understand what your concern is and what you would like to happen about this. Once they have spoken to you, the manager will write to you within ten working days of you raising your concerns.”

From this is seems that they aim to respond to your complaint within 10 working days. If there are any factual errors or omissions in their report, the CFR should be notified immediately in writing, giving them the opportunity to make amendments before the court hearing.

In some instances the court directions will provide for further statements following the filing of the welfare report so that the parties can comment on it. If this is the case then you may want to prepare a statement outlining your concerns.

You can also challenge the report, by questioning the Children and Family Reporter in court. This is only possible with a direction of the judge. If a direction hearing is scheduled then you can request this at the hearing, otherwise you may need to complete a C2 form to request a direction hearing and then submit your concerns and ask permission to cross examine the Children and Family Reporter.

Although it is sensible to wait until the filing of the report (especially if you requested amendments), if you delay it may present practical difficulties, namely the reporting officers may by then have arranged other appointments for that particular day.
