HI
My husband is being taken to court by his ex to allow her to take their son to France. We do not have a solicitor what paper work do we need to submit? What is a file 4?

Dear Helen,

Thank you for your query.

It sounds as if your husband's ex partner is applying for permission to take the child abroad. As mum is making the application she will be the applicant and your husband the respondent. It is the applicant who is responsible for filing papers at Court, your husband will simply have to wait until the court hearing where the judge will give instructions, at which point there may be documents/statements etc which your husband is requested to submit.

When mum files the application, papers will be sent to dad. Dad will need to complete a form enclosed and return this to Court; this is to show that dad has recieved the court papers, is aware mum is making an application and knows when the court hearing is.

Your husband is able to represent himself and the Court will not expect him to have to knowledge of a solicitor.

In relation to the 'file 4', without more information on the context I am afraid we cannot advise in this regard. Please do contact us again with further information.
