I have been raising 2 children ( girl 6 and boy 4) for 4 years now with their mum seeing them at weekends and we split the holidays. The little girl is not mine biologically but I have been her dad since she was 9 months old ( and knows no different).
Today I recieved a copy of an application for full residency from the courts, with many false accusations. The court seemed to have refused the application because she had not gone down the mediation route. However the court still sent me a copy of said application.
I am to assume that I will recieve an invite to mediation and will accept, however it will not go well. The mother is very volatile and will not even recognise or admit the to the reasons why the children are with me.
I was seething when I first read the accusations, only to discover that throughout the application there are many contradictions and would be laughed out of court.
My questions are twofold;
Firstly, are there any known cases when a non biological father has won a residency case against the biological mother.
And secondly, Arent false claims or accusations classed as libel and will they be treated as so if proved to be just that?

Any info would be greatly recieved. I have a solicitor appointment soon and also have support of the school and behavioural support ( girl has issues from being in care from 0 to 3 months, according to reports) and childrens services have been informed and know of previous concerns.
