[Solved] Restoration Order

Does anyone know anything about these? I've been denied access to my house for the last 6 months and went to court for the financial hearing a few days ago. The judge repremanded the other half for not allowing me to access documents. I am self-repping and gonna write to her solicitor requesting that I access the house. Wife will refuse - can I get access back to my house with this order?

Hi Boycie,

Arent you entitled to access and occupation unlss there is a non mol or injunction?

That being the case shouldnt your ex allow access.

Obviously at an agreed time etc.

hi Boycie, DaveR is right, I would suggest you arrange an appointment via her solicitor, and take someone with you too.

She has flatly refused.....simply NO I am not ever returning to the house

She did ask that I provide a list which she has yet to return.

I also suspect most of my documents etc have been filtered through anyway.....

She cant flatly refuse you to get your personal papers!

Any items out of furniture, cds, dvds etc I can understand, most of them do that - but get your solicitor to do the asking. Especially now the Court reprimanded her solicitor.

Thank you - she has refused to let me in the house......Solicitors have said she has instructed this order on a number of correspondence that I am not allowed in my own house.

I am now self repping, much more therapeutic. Direct Access is definitely the way forward when you suddenly click that solicitors will not get you anywhere if someone is not willing to cooperate.

Actually judge reprimanded her, not solicitors, "madam your not really doing yourself any favours claiming all this and not allowing your husband to obtain his documents". :whistle:

You've got to love the way judges say things sometimes - the veiled threat without any threatening language.

I would still try again, via her solicitors, stating something along the lines that in view of the Judge's comments at the last hearing, you want access to the property, with a third party.
