My children are 17 and 22 - I separated from their mother 9 years ago and have always paid more than i am obliged to for both maintenance and the mortgage. I am about to embark upon a 6 month sabbatical from work to go travelling. During which time i shall be earning nothing and finances will be tight. My ex partner is financially secure. Does anyone know whether I am obliged to pay the same amount of maintenance when I am not earning anything?

Hi,

My understanding and from a similar question here a while ago, if you aren't earning then you aren't liable to pay anythingh however if you have assets to your name then these could be taken into account by the CSA towards payment.

I think i've got that right the similar question was a reverse, so a mother not paying as she was planning a around the world trip on her own boat, from memory the answer came back that the boat would show as an asset and could be taken into acount.

Is your son still in full time education?

And more importantly have you spoken to your ex and your children acout this and what are thier views?

no matter what the rules say you may be able to come to your own arrangement.

Darren
