[Solved] Schedule of Inhibition

Hi, I have received a Schedule of Inhibition. This was delivered by sheriff officers. It has been raised by the CSA in Australia with a solicitor in Edinburgh acting for them. The amount is £17.500.
I met a girl who was travelling and we had a casual relationship. (Protection always taken). She was over the moon when she knew she was pregnant, I was shocked as always carefully! Her friend told me its what she wanted and she had set out to get pregnant, they no longer talk because of this.
She went back to Australia, I went with her against the wishes of many! She wouldn't discuss abortion as she wanted baby despite distance! My father offered her £10,000 even though she told us she wouldn't ask for a penny! She was happy to accept money but was advised not to as would get more money going to CSA and she could also get legal aid and benefits.
I found out she had been sleeping about, (ex friend of mine being 1) so I had DNA done which proved child was mine, gutted and trapped!
She then met new partner and fell pregnant in Oz 3-4mths after giving birth. She split with partner and doesn't ask him for money as he would then get some form of custody! Any previous money I sent is therefore paying two children!
Whilst I know I have zero rights, zero custody etc I'm having to pay money! I was going to re mortgage but this order prevents that! What am I meant to do?? I was also told I would need solicitor in Australia which I simply can't afford and times running out fast! Whilst very unhappy at situation as feel trapped I would prefer to pay any money into savings account so at least I know my son would get it rather than both children!
Why should one pay and not the other? Really stressed and don't know where to turn before officers take me to cleaners!! Any help and advice would be great! Thanks

Hi There,

Sorry to hear of your troubles,

You mention a solicitor being appointed in Scotland are you living in Scotland?

I really have no experience in this and our childrens legal services can only comment on childrens law and only if you are in England (not Scotland I'm afraid)

I would try and seek some legal advice around the this as you are going to need to act quickly.

Darren

Hi..yes, I live in Edinburgh but because its an Australian court I've been advised to get a solicitor in Australia! 2500 dollars just to get the ball rolling I was quoted!

I' now have meeting with Citizens Advice but not sure how helpfull they will be!

I want to re mortgage but this order prevents that by the looks of it.

Hi

Contact the Scottish Child Law Centre - www.sclc.org.uk - they may be able to give you advice, but certainly hopefully some pointers in the right direction.

Hi thomsr,

I have moved this thread to over to the legal section because it is more logical that it appear here.

Sorry to hear about your issues, that sounds quite a situation to be in. actd is correct the Scottish Child Law Centre are the best people to speak to - another thought I had was, have you tried speaking to the British Embassy in Australia, they may be able to put you touch with someone in Australia who might be able to help you (and may cost less).

Hope this is of some help.

Gooner
