hi guys, i was wondering if anyone could give me some tips as im due at court on wednesday morning. i will be attending with the hope that i can get a specific issues order put in place to keep my son in the school he is in. just to let you all know a little about the past, i have a shared residency order in place, whereby im the main carer of my son. my ex partner has been wanting to change my son school for a while but so far i have managed to keep him where he is. she made excuses to the judge that she didnt have the finances to get my son to and from school, so i agreed to meet the travel costs for both her and my son to ensure he stayed where he was, as a change would have had a major affect on his welfare after what he has been through. the judge agreed to write into the preamble on the order that my son was to stay in the school, providing i meet the travel costs of both my ex and son to get him to and from school ONLY. my ex has been using both bus passes when she shouldnt have and before the summer holiday it worked out that 8 of my sons passes had been misused and 10 of my ex's so i decided to confront her about it. i got a lot of abuse off her when i informed her that i had logs of her misusing the passes so told her that she had to replace the passes. on the last day of term, i had the head teacher phone me to ask if i knew anything about my son changing school after the holiday, obviously i didnt know what she was on about. i managed to contact the education department and they have put the application on hold until i have been to court.

i apologise for this being so lengthy to read. if anyone can give me an idea of what outcome i could possibly be facing on wednesday and any tips, it would be much appreciated as im going it alone with no legal representation.

It's impossible to predict what will happen I'm afraid... I think if you get a good judge who looks at all the evidence, you stand a good chance.

The judge has already agreed in principle to your son staying at the same school, this acknowledgement is favourable. The fact that she has tried to change schools behind your back doesn't look good, neither does the misuse of the bus passes.

You've been in court before so you know more or less what to expect....just be calm and reasonable and don't be afraid to challenge anything that you don't agree with or you can prove is wrong.

Hi There,

I would progress this matter demonstrating that your child's best interests are best served by him staying where he is. Back this up with pictures of him with class mates, outings with classmates, celebrations with class mates, BUT MOST OF ALL school reports that show your child's development is right on track, if not ahead of others. The judge will have to give all this weight.

hi everyone, just to let you know, i just got back from court and it went in my favor, an order has been made to keep my son at his school. my ex told a lot of lies which i produced evidence to prove her wrong and she left in tears.

i have been very lucky because, each time i have been to court so far it has always gone in my favor. My ex needs to learn that lies dont get you anywhere unless you can back up what you say but it just so happens that i have been one step ahead all the way. If she had been fair in the first place, then it wouldnt have had to come to this and now she had paid dearly by showing her true colours to everyone, especially the judges.

It has been a long and costly experience, one that i hope i never go through again but in the end its all been worth it.

can i just say to all those dads out there that are going through what i have been through, THERE IS LIGHT AT THE END OF THE TUNNEL!! keep fighting for your rights of being a parent and hopefully one of these days each and every child will be able to have contact with both parents, especially their father's.
