My ex has already been to a solicitor and i have received a letter from them i used a solicitor who wrote to my ex partners solicitor who gave them 14 days to reply but they did not reply to my solicitors letter. I am now goin to be representing myself. Do i send my ex a letter as a solicitor would with what i want or do i just make the court order.

Thank you for contacting the Children’s Legal Centre, an independent charity concerned with law and policy affecting children and young people.

It is good practice to let your ex partner know that you intend to make an application to court for an order.
However it is your choice whether you write to her and do this or whether she is made aware when served with court papers.

There is no obligation for you to send your ex partner a letter stating that you are now applying to court unless you wish to do so.

There is guidance and information on making the application to court available from www.hmcs.gov.uk which may also be helpful to you. The relevant guidance forms are CB1 and CB3.

We hope this information is useful, should you require further advice please contact our Child Law Advice Line on 0845 120 2948.

Kind Regards

Children’s Legal Centre
