[Solved] Urgent Help

Evening,

Can i please have some urgent help, my partner (& her ex) have been served via their solicitors court summons to attend family court (on 7th Oct - this monday coming).
My partners ex's solicitors have received the summons today, my partners solicitors haven't received anything yet, nor have mine.
We've also no idea what this is for.
We suspect its for a court order for documents from their previous case to be released into my proceedings.
Are they able to do this at such short notice & is there anyway to push it back / through un fair play etc?

hi there,

this is very short notice, so you should be able to push it back by contacting the courts.

The court will understand that you can't just drop everything at such short notice.

What reason can I say to have it pushed back? Will they just do it if I say we've only been given 2 working days to prepare?

My partner's solicitors were served via email late last night saying to appear on Monday.
My partner now cannot get legal representation as there is nobody available Monday - this is of grave concern as the papers are from my partners previous proceedings.
It may look like my partner will need to self-rep, can i have some guidanc from someone for reasons for the papers not to be released?
My ex has legal aid so will be having a solicitor attend, i also have a solicitor, our argument is that the papers are 'ok' to be released but only to the social worker compiling the report & not made available to my ex or her solicitors as there is very sensitive information about my current partners family & child hood that is not public knowldge, the only people to have seen such information to date is her solicitors, myself & previous social workers.

I'm guessing you're going to struggle to get a quick answer here so i'd recommend you contact these people and ask their legal team for their advice

Hi d-i-d - I've taken out the link - the CCLC aren't able to give advice where there is already a solicitor acting, it's a condition placed upon them, not one of their own rules.
