[Solved] wha age can my daugther legaly live with me

my daughter Lauren comes to stay with me 2/3 times a year as her mum and i are divorced but recently Lauren has told me she doesn't want to live with her mum as she has mental issues and she has been attacking her new 76 year old boyfriend who is ready to leave at any time as on on au cation Dave ( her boyfriend ) was ill after an argument and he clasped on the floor and at the same time he was getting kicked (whilst on the floor) by my ex wife . but the problem is that we don't know how to tell her mother as she may come up to Scotland and cause a big scene so what advise would you give me on how to tackle this and some of the laws about this like what legal age in welsh law can a child decide which parent to live with as my daughter is 12 nearly 13 so please reply as we only have about 2 weeks till we have to tell her mum

I am not able to answer your question - have you spoken to a solicitor?

Surely if the mother is behaving like this there is a risk she may attack your daughter?

Hi Ian

I'd have a word with the Scottish Child Law Centre http://www.sclc.org.uk and see what they say about going for residence - it might not be as simple as your daughter simply coming to you, and also to check whether it would come under Scottish Law or English Law.

Is there a residence order in place or was it simply an agreement between you and your ex at the time?
